These Terms and Conditions apply to all services, works, repairs, electrical installations, emergency services, callouts, interstate services, transport of customer equipment, supply of goods, quotations, and website use provided by Chubbys Services and Repairs (“we”, “us”, “our”). By engaging our services, requesting a quote, booking a callout or site visit, paying a deposit, or using our website, you agree to be bound by these Terms.
1. Quotations and Acceptance
- Any quotation is based on information supplied at the time and is valid for 30 days unless stated otherwise.
- Quotations may change if the scope of work, site conditions, access, compliance requirements, equipment specifications, or information provided changes.
- Acceptance occurs when you approve a quote, confirm a booking, pay a deposit, instruct us to proceed, or accept delivery of works or goods.
2. Pricing and Variations
- Prices are based on current labour and material rates.
- Variations required due to unforeseen conditions, inaccurate information, safety issues, noncompliant installations, or regulatory requirements may result in additional charges.
- We reserve the right to pause works until variation pricing is approved.
3. Payment Terms
- Unless otherwise agreed in writing, payment is due upon completion of works or as stated on the invoice.
- Deposits may be required prior to commencement and may be nonrefundable where costs, travel, materials, scheduling, or commitments have been incurred.
- Late payments may incur interest at 9% per annum, calculated daily, plus reasonable recovery costs.
- We may withhold compliance certificates, warranties, documentation, or future services until full payment is received.
4. Cancellation and CallOut Fees
- A callout fee may apply to all attendances, diagnostics, site visits, equipment collections, or service visits and is payable regardless of whether work proceeds.
- Cancellations or rescheduling:
- More than 24 hours’ notice: no cancellation fee (unless special arrangements were made).
- Less than 24 hours’ notice or noshow: a cancellation fee may apply.
- If works cannot proceed due to access issues, ineffective isolation, unsafe conditions, or inaccurate information supplied by the customer, the callout fee remains payable.
5. Emergency and AfterHours Services
- Emergency, urgent, afterhours, weekend, or publicholiday services may attract higher labour rates, minimum charges, or emergency attendance fees.
- Emergency attendance does not guarantee immediate or permanent rectification.
- By requesting emergency or afterhours services, you agree to the applicable conditions.
6. Ownership, Risk and Materials
- Ownership of supplied goods remains with Chubbys Services and Repairs until payment is received in full.
- Risk passes to the customer upon delivery or installation, whichever occurs first.
- Customersupplied materials or equipment are used at the customer’s risk and must be suitable, compliant, and fit for purpose.
7. Electrical Work, Compliance and Australian Consumer Law
- All electrical work is carried out in accordance with applicable Australian Standards, statebased electrical safety legislation, and licensing requirements.
- Our services and goods come with guarantees that cannot be excluded under the Australian Consumer Law.
- We are not responsible for preexisting faults, latent defects, or noncompliant customersupplied equipment or installations.
- Electrical compliance documentation will be issued only where required by law and upon completion of works and receipt of full payment.
- Where permitted by law, remedies are limited to repair, replacement, or resupply.
8. Limitation of Liability
To the extent permitted by law, we are not liable for indirect, consequential, incidental, or economic loss, including loss of profit, business interruption, or loss of goodwill. Total liability will not exceed the amount paid for the relevant services.
9. Indemnity
You indemnify Chubbys Services and Repairs against claims, losses, damages, or costs arising from unsafe site conditions, incorrect information, noncompliant equipment, failure to ensure effective isolation, or misuse of goods.
10. Termination
We may suspend or terminate services if payments are overdue, access cannot be obtained, works are unsafe or unlawful, or these Terms are breached. Accrued rights and payment obligations survive termination.
11. Governing Law
These Terms are governed by the laws of Queensland, Australia. For services performed interstate, the Australian Consumer Law applies nationally. The parties submit to the nonexclusive jurisdiction of Queensland courts.
12. Site Access, Parking and Compliance Requirements
- The customer is responsible for ensuring safe, timely, and unrestricted access to the site, including building access, inductions, portals, and security requirements.
- Attendance fees may apply where access cannot be obtained due to sitecontrolled systems.
- Any costs associated with inductions, permits, or compliance systems are the customer’s responsibility.
- Parking, tolls, or access charges incurred will be added to the invoice where onsite parking is unavailable.
13. Travel and Interstate Services
- Services may be provided throughout Queensland and other Australian states by agreement.
- Travel outside our standard service area may incur additional charges disclosed prior to attendance where practicable.
- Travel time may form part of billable service time.
14. Parts, Return Visits and Incomplete Works
- Spare parts are supplied separately from labour.
- Return visits required due to parts availability or additional diagnostics may incur further charges.
- We are not responsible for delays caused by suppliers, manufacturers, or freight providers.
15. Commercial Clients and Purchase Orders
- Where a Purchase Order is required, it must be provided at booking or no later than 24 hours prior to attendance.
- Failure to provide a Purchase Order may delay invoicing or suspend further services.
16. Transport and Handling of Customer Equipment
- Transport of customersupplied equipment (including washing machines, dryers, and sterilisation equipment) is undertaken at the customer’s risk unless otherwise agreed in writing.
- We are not responsible for preexisting damage, latent defects, internal failures, or leaks that manifest during or after transport.
- Customers warrant that equipment is suitably prepared, drained, and suitable for transport unless preparation is expressly included in the agreed services.
- Insurance for transported equipment remains the customer’s responsibility unless agreed otherwise in writing.
17. Installations, Site Inspections and Documentation Requirements
- A preinstallation site inspection may be required before providing a final quotation or commencing installation works.
- Any quotation provided without a site inspection is indicative only and based solely on information supplied by the customer.
- Customers must provide current and accurate documentation, including updated drawings, equipment specifications, site measurements, service locations, and electrical load requirements.
- Additional works, delays, or reattendance caused by outdated or incorrect documentation will be charged as variations.
- Installations are conditional on the site being adequately prepared, compliant, and safe.
- We may refuse or suspend works where site conditions or equipment do not comply with Australian Standards, manufacturer requirements, or safety regulations.
- Attendance and labour costs remain payable where installs cannot proceed due to site readiness or information failures.
18. Customer PreInstallation Checklist (Acknowledgement)
Prior to installation, the customer confirms that:
- Site access, inductions, and safety requirements are complete;
- Updated drawings, plans, and specifications have been supplied;
- Equipment models, dimensions, weights, and connection requirements are confirmed;
- Electrical supply, isolation, earthing, and load capacity are compliant;
- Required utilities (power, water, drainage, ventilation) are available and functional;
- Mounting surfaces and clearances are suitable and compliant;
- Any thirdparty preparatory works have been completed.
Failure to meet these requirements may result in delays, variations, additional charges, or rescheduling.
